Abstract This paper proposes a cross-reading between Niklas Luhmann’s systems theory and the studies on neoliberal governmentality inspired by Michel Foucault. Instead of suggesting a deficit in the autopoiesis of systems, the text advances the hypothesis that neoliberalism is expressed in the form of a colonization of the operational mechanisms of functional systems: law and politics, especially, are taken by a specific economic rationality that governs their forms of self-reference (reflexivity and reflection) and hetero-reference (second-order observation, mainly by science). Due to this specific colonization of the autopoiesis of functional systems, neoliberal rationality paradoxically maintains functional differentiation but restricts its assumptions: a degree of social inclusion and systemic disintegration that allows maintaining the distinction between economic, political and legal codes and programs.

Resumo Este artigo propõe uma leitura cruzada entre a teoria dos sistemas de Niklas Luhmann e os estudos sobre governamentalidade neoliberal inspirados por Michel Foucault. Em vez de sugerir um déficit na autopoiese dos sistemas, o texto avança a hipótese de que o neoliberalismo se expressa na forma de uma colonização dos mecanismos operacionais dos sistemas funcionais: o direito e a política, especialmente, são tomados de uma racionalidade econômica específica que passa a reger suas formas de autorreferência (reflexividade e reflexão) e heterorreferência (observação de segundo grau, sobretudo pela ciência). Por essa específica colonização da autopoiese dos sistemas funcionais, a racionalidade neoliberal paradoxalmente mantém a diferenciação funcional mas restringe seus pressupostos: um grau de inclusão social e desintegração sistêmica que permita manter a distinção entre os códigos e programas econômicos, políticos e jurídicos.

Resumo A resenha avalia criticamente o livro Legal theory and the media of law, de Thomas Vesting. O autor visa a apresentar uma concepção multidisciplinar de teoria do direito, analisando a coevolução entre fenômenos jurídicos, suas autodescrições e os meios de disseminação da comunicação, das culturas orais às redes de computadores. O texto posiciona a contribuição de Vesting na trilha moderna da teoria e filosofia do direito alemãs.

Abstract This review critically assesses the book Legal theory and the media of law, by Thomas Vesting. The author seeks to present a multidisciplinary conception of jurisprudence, analyzing the coevolution between legal phenomena, their self-descriptions and the dissemination media of communication, from oral cultures to computer networks. The paper posits Vesting’s contribution in the modern path of German jurisprudence and philosophy of law.
